The terms and conditions governing your use of JetCad3 software and jetcad.io.

These Terms of Service ("Terms") govern your access to and use of JetCad3 software and the jetcad.io website (collectively, the "Service"), provided by JetCad, LLC, a Michigan limited liability company ("JetCad," "we," "us," or "our").
By creating an account, purchasing a subscription, downloading the software, or otherwise using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms, and "you" refers to that entity.
If you do not agree to these Terms, do not use the Service.
To use the Service you must be capable of forming a legally binding contract. For paid subscriptions and physical goods purchases, you must be at least 18 years of age, or the age of majority in your jurisdiction if higher. By purchasing, you represent that you meet this requirement.
You must create an account to access paid features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at admin@jetcad.io if you suspect unauthorized access to your account.
You may not create accounts using automated means, share your account credentials with others, or use another person's account without authorization.
Subject to your payment of applicable subscription fees and compliance with these Terms, JetCad grants you a limited, non-exclusive, non-transferable, non-sublicensable license to download and use the JetCad3 desktop application on devices you own or control, solely for your internal business or personal use.

We may release updates, patches, or new versions of the software from time to time. Updates are part of the Service and subject to these Terms. We are not obligated to provide any specific update or to maintain any particular version of the software.
Paid subscribers receive cryptographically signed offline license keys that allow the software to function without a continuous internet connection. These keys expire periodically and are renewed automatically while your subscription is active. License keys are personal and non-transferable.
JetCad3 is offered on a subscription basis. Current plans and pricing are described at jetcad.io/pricing. We reserve the right to change pricing with 30 days' advance notice to existing subscribers.
New subscribers may be eligible for a free trial period as described at the time of sign-up. A valid payment method is required to start a trial. If you do not cancel before the trial ends, you will be automatically charged the applicable subscription fee.
Subscriptions are billed in advance on a monthly or annual basis, depending on the plan you select. Your subscription automatically renews at the end of each billing period unless you cancel. You authorize us (through our payment processor, Stripe) to charge your payment method on file at each renewal.
You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of your current billing period. You retain access to the Service through the end of the period you have paid for.
All subscription fees are non-refundable. There are no refunds or credits for partial months, unused periods, or periods during which you did not use the Service. If you cancel mid-period, your access continues until the period ends and no refund is issued for the remainder.
We understand this is a firm policy. If you have an exceptional circumstance, you are welcome to contact us at admin@jetcad.io and we will consider it on a case-by-case basis, but we make no commitment to issue refunds.
If a payment fails, we will attempt to notify you by email. Access to paid features may be suspended until payment is resolved. If payment is not resolved within a reasonable time, we may cancel your subscription.
Prices are exclusive of applicable taxes unless otherwise stated. You are responsible for all applicable sales, use, VAT, GST, or other taxes arising from your purchase. Stripe may calculate and collect applicable taxes on our behalf.
Physical goods available through the JetCad store (including JetFlight controllers, apparel, and accessories) are subject to these Terms, the Refund & Return Policy, and the Shipping Policy, each available at jetcad.io/legal.
By placing an order you represent that the shipping address and payment information you provide are accurate and that you are authorized to use the payment method.
Title and risk of loss for physical goods transfer to you upon handover to the carrier.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

JetCad3, the JetFlight name and associated hardware designs, the jetcad.io website, and all related software, code, designs, documentation, trademarks, and trade secrets are owned by JetCad, LLC or its licensors. Nothing in these Terms transfers any ownership of our intellectual property to you.
You retain ownership of any content you create using the Service, including CAD files, toolpaths, machine configurations, and post processors. We claim no ownership over your work product.
If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, royalty-free license to use that feedback without restriction or compensation to you.
The Service integrates with third-party services including Stripe (payments), Clerk (authentication), Google Drive, and OneDrive. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices or availability of third-party services.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, JETCAD DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
We do not warrant that the Service will meet your specific requirements, that output generated by the software will be free of errors, or that the software is suitable for use in any particular application including safety-critical manufacturing or cutting operations. You are solely responsible for verifying the suitability and safety of any toolpath or machine configuration generated by the software before use.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JETCAD AND ITS MEMBERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PROPERTY DAMAGE, OR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN FULL.
You agree to indemnify, defend, and hold harmless JetCad, LLC and its members, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) any content you submit or transmit through the Service.
We may suspend or terminate your account and access to the Service at any time, with or without cause, with reasonable notice where practicable. You may stop using the Service and close your account at any time.
Upon termination, your license to use the software ends. Provisions of these Terms that by their nature should survive termination will do so, including Sections 7, 9, 10, 11, 13, and 14.
These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict of law principles.
Any dispute arising out of or related to these Terms or the Service that cannot be resolved informally shall be submitted to binding arbitration under the rules of the American Arbitration Association, conducted in Michigan. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm pending arbitration.
Class Action Waiver. To the extent permitted by law, you agree to bring claims only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
We may modify these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and send an email notification to registered users. Continued use of the Service after the effective date of changes constitutes your acceptance of the updated Terms.
Entire Agreement. These Terms, together with the Privacy Policy, Refund & Return Policy, and Shipping Policy, constitute the entire agreement between you and JetCad regarding the Service and supersede all prior agreements.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
No Waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of our assets.
